New York sues Attyx (formerly SUNco) and two lenders over 'free' solar and roof offers

2026 United States Ongoing

On March 17, 2026, New York Attorney General Letitia James sued Attyx LLC (formerly SUNco), two of its CEOs, and the lenders Solar Mosaic and WebBank, alleging the company sold solar systems and home repairs as free, misrepresented government incentives, and left homeowners, many of them elderly or on fixed incomes, with loans they had not understood. The complaint puts the amount generated in New York at approximately $275 million. The case is a pending civil lawsuit; none of the allegations have been decided by a court.

The facts, as recorded

Why this case matters

It is the clearest recent example of the scheme’s shape: the offer is “free,” the price is a loan, and a lender that funds the sale sits in the middle. New York sued the two lenders alongside the installer, alleging they collected hidden fees built into the price, so the theory of harm reaches past the salesperson at the door.

What was said versus what was signed

According to NYS Focus, sales representatives visited homes and had customers e-sign on tablets without the terms being fully explained. The State’s complaint describes contracts that were unsigned or not reviewed with customers. In the reported example, a Queens homeowner who answered an ad aimed at seniors learned of a $160,000 loan only after she had been enrolled, and found she could not simply cancel.

The caveat

This is a civil lawsuit filed by the State of New York. Everything above is an allegation; the defendants are presumed not liable unless and until a court finds otherwise, and this page does not report any finding against them. The $275 million figure is the State’s own estimate of what was generated in New York, as stated in its complaint announcement.
